$8.3 Million Judgement against Johnson & Johnson DePuy ASR Implant Trial
A Los Angeles jury Friday awarded $338,136.12 in medical expenses and $8 million for pain and suffering to plaintiff Loren Kransky after a six-week trial, saying Johnson & Johnson defectively designed their ASR implant. After receiving the ASR implant, Kransky suffered dislocations and pain and had to suffer through multiple surgeries to correct the device. Although Kransky’s case was filed in California state court and was not part of the multidistrict proceedings in Ohio, the verdict will likely have an impact on the upcoming bellwether trials in the multidistrict litigation. Said Kransky’s attorney after the trial, “This is the first day of reckoning for DePuy.”
More trials are scheduled to take place this year, with the next trial scheduled to begin this week in Chicago. Over 10,000 lawsuits over the ASR hip are pending throughout the country and analysts are estimating that resolving these suits could cost Johnson & Johnson billions of dollars.
