Can Siblings File A Wrongful Death Claim?

When Can Siblings File A Wrongful Death Claim?

As of January 1, 2025, the law has changed for whom may file for a wrongful death lawsuit, and when, particularly for siblings. Colorado House Bill 24-1472 reads:  

“IF, AT THE TIME OF DEATH, THERE IS NO SPOUSE, NO HEIR OR HEIRS, AND NO DESIGNATED BENEFICIARY, OR, IF THE DECEASED WAS AN UNMARRIED MINOR WITHOUT DESCENDANTS OR AN UNMARRIED ADULT WITHOUT DESCENDANTS, AND THERE IS NO MOTHER AND NO FATHER OF THE DECEASED…” 

The individual or individuals may now file a wrongful death claim in the first year of death. 

In plain English, this means that when your loved one unfortunately died, and: 

  1. There is no spouse or heirs (generally children).

AND 

  1. There is no other designated beneficiary, like in a will.
    OR
  2. If the deceased person was a minor who was not married, with no parents.
    OR
  3. The deceased was an unmarried adult without any descendants (children), and there is no mother and father of the deceased.

THEN

  1. Siblings are able to sue for wrongful death in the first year of death.

What Types Of Damages Can Be Recovered In A Lawsuit For Wrongful Death?

There are generally two types of damages people can claim in wrongful death lawsuits: economic damages and non-economic damages.

Economic damages are, in layman’s terms, damages that can have a distinct price put on them. These include: 

  • Medical expenses prior to death
  • Funeral costs
  • Loss of financial support that the diseased person could have contributed
  • Loss of benefits like insurance and pensions from the deceased

The monetary amount of these damages are unlimited. This means there is no upper limit to these kinds of damages families can claim from wrongful death lawsuits. 

The other type of damages are called non-economic damages. These include things that are more difficult to put a distinct number on. They may include: 

  • Pain and suffering
  • Emotional damage 
  • Grief
  • Trauma
  • Loss of companionship 
  • Etc. 

As of 2025, non-economic damages have been changed in the Colorado General Assembly. Unlike economic damages, these kinds of damages do have a cap on how much can be paid out. In this last bill, the cap was increased to 1.125 million dollars, although this is subject to inflation increases beginning in 2028.

In Colorado, a wrongful death is when someone is killed due to negligence or recklessness on behalf of another party. This means that someone acted out of accordance with their duties as a citizen, and that resulted in a death. The most common occurrences of wrongful death are during incidences like:
