Employment Discrimination
Both Title VII of the Federal Civil Rights Act of 1964 and state and local law forbid different or unfavorable treatment in hiring, promotion, discharge, pay, benefits, training, and more based on certain “protected classes,” including race, skin color, national origin, gender, disability, religion, age, sexual orientation [e.g. identification as LGBTQ or LGBTI.] On the other hand, even favorable treatment, like higher pay, for individuals based on these same classes is against the law because equality demands equal pay.
Termination due to race, age, sex, pregnancy, national origin, marital status, color, religion, or disability is illegal in Florida. If your employer has 15 or more employees (and in some counties, 5 or more employees) you may be protected from this type of termination.
Pregnancy Discrimination
The Pregnancy Discrimination Act (PDA) amended Title VII of The Civil Rights Act of 1964 prohibits discrimination because of pregnancy, childbirth, or related medical conditions. Women who are pregnant or are affected by pregnancy-related conditions must be treated in the same manner as other applicants or employees with similar abilities or limitations. Likewise, a nursing mother who needs designated times and a designated place for pumping cannot be treated unfairly for doing so.
Age Discrimination
Age discrimination may occur when an employee over 40 years of age is terminated on the sole basis of his/her age. In a layoff or reduction in force, the employer is required to provide you with a list of the ages of the others who were laid off or positions eliminations to determine whether age discrimination has occurred.
Sexual Harassment at Work
Sexual harassment is a serious issue and is not limited by industry or occupation. The negative impacts of sexual harassment can extend from someone’s job to serious health and medical conditions because of the pressure and stress created by such situations. Often, individuals experiencing sexual harassment leave their positions because of the overwhelming impact on their lives, even though walking away from their job was otherwise unwarranted simply to avoid being blamed for their reaction to such harassment or the harassment itself. At Bachus & Schanker, we hold the employers who have allowed or condoned inappropriate sexual conduct and harassment responsible because no one should have to be subjected to sexual harassment under any circumstances, especially in the workplace.
Making a Worker’s Compensation Claim
It is illegal for an employer to terminate you for making such a claim.
Taking Leave
It is illegal to terminate or retaliate against you because you have taken leave under the Family Medical Leave Act. If you have worked at least 12 months (can be nonconsecutive) and the employer has 50 or more employees, you may have a Family Medical Claim Act claim for leave due to bereavement, sickness, disability, birth or adoption of a child, or a serious medical condition of a family member.
Retaliation for Reporting or Objecting to Discrimination
You cannot be fired or retaliated against for reporting sexual harassment or discrimination whether it occurred to you or someone else.
Being Owed Overtime or Wages
You cannot be terminated for objecting to not be paid or objecting to improper classification of an employee or an independent contractor. In addition, violation of the Fair Labor Standards Act occurs if you work off the clock, if you were denied pay for at home work on call time, or short daytime breaks, misclassified as exempt from overtime pay when you should receive it, or when your employer averages hours over two work weeks.
Breach of Contract
Some employment relationships establish a contract. If you have a contract that says you cannot be terminated for cause, the employer may have to pay you the remainder of the contract.
Severance Review
Even if nothing illegal happened some employers decide to provide employees with a severance package.
