Update on ASR TM Hip Replacement Recall
Recipients of revision surgery after Aug. 31, 2013 deadline may file claims
The courts are now evaluating cases for patients who received the ASR hip replacement revision surgery after August 31, 2013.
DePuy Orthopedics, a subsidiary of Johnson & Johnson, is in the process of distributing payment to the plaintiffs who were eligible for and chose to “opt in: to the $2.4 billion settlement program announced in November 2013. In order to be eligible for the settlement program, plaintiffs had to have undergone a revision surgery to remove their ASR hip implant by August 31, 2013. Many ASR victims have undergone a revision surgery since that date and the court is now overseeing settlement talks for these plaintiffs.
According to reports, thousands of Depuy ASR hip implant recipients suffered metallosis, chromium and cobalt toxicity, and premature revision surgery after receiving a Depuy ASR hip implant, prompting a recall of the device in August 2010.
If you did not meet the August 31, 2013 requirement for the November 2013 ASR Settlement program but have since undergone a revision surgery, your time to file a claim may be limited and you should contact an attorney right away.
