$450k Resolves Case for Bachus & Schanker, LLC Client
Bachus & Schanker, LLC recently negotiated a $450,000.00 settlement for their client, Brian M., who was severely injured when he was run over by a delivery truck.
On November 17, 2004, Brian M. was working to open a new Denver restaurant and bar. He had moved to Colorado specifically to open and launch the restaurant and bar and get the business established. On the afternoon of Nov. 17, Brian was helping guide a delivery truck into the ally of the restaurant. The driver of the delivery truck suddenly pulled forward and to the left and trapped Brian between the truck, the concrete corner of the building and a patio railing. Brian was trapped and had no where to go.
Brian tried to get the driver's attention, however, the driver, paying no attention, continued drove forward and to the right. The right bumper of the truck crashed into a corner of the concrete wall, forcing the concrete wall into Brian's right thigh.
Brian was pinned by the truck, yet the truck kept moving, dragging Brian along the rail. Eventually, Brian was able to tear his leg off the truck. Brian was rushed to the emergency room with more than 1 ½ feet of his right leg slashed completely open. For more than seven months, Brian endured three surgeries, numerous infections, and has a permanent deformity in his leg. He missed nearly 34 weeks of work and had to learn to walk again.
Brian, a former football and rugby player, has remained strong and is working hard every day to make progress on his recovery. Brian knows it will be a long, slow process, but he is focused on getting stronger every day. He diligently follows his therapy requirements and is thankful for each new milestone he reaches in his recovery.

Schanker was able to help Brian with his Workers' Compensation claim, as well as conducting the necessary accident investigation. Prior to filing a lawsuit in this matter, the insurance company for the truck driver requested that the parties attend a settlement conference, which is a rare request prior to filing a lawsuit. At the settlement conference, the insurance company representatives heard all about the negligent, reckless conduct of their insured, and learned more about Brian and the life-long ordeal he will endure as a result of this incident. Nearly two years after this horrific incident, the insurance company agreed to resolve this matter with Brian.
