Colorado has written civil dog bite laws. Colorado Revised Statute 13-21-124 is the civil dog bite law. The law says that a victim may have the right to compensation when a dog bite hurts them. The victim’s right to compensation doesn’t depend on whether the dog has a bite history. Instead, the legal standard for compensation depends only on the severity of the victim’s injuries.

Strict liability for serious dog bite injuries – If a victim has serious injuries, the dog owner has strict liability for the victim’s injuries. A serious injury is any substantial risk of death, permanent disfigurement, impairment of a bodily function or organ, a broken bone, fracture or serious burns. For strict liability to apply, the victim must be lawfully on public or private property when the dog bite occurs. When strict liability applies, the victim doesn’t have to prove that the dog owner did anything improper or negligent regarding the dog. The fact that the dog bite occurred is enough to render the dog owner liable to the victim for their injury.
